Privacy Policy

This is Jessica's Limited’s (trading as Jessica's Wig & Beauty Salon) policy on the management of personal information (“Privacy Policy”). In this Privacy Policy “we”, “our” and “us” refer to Jessica's Limited. Our Privacy Policy applies to personal information held about individuals. It does not apply to information we hold about companies and other organisations.

Please read our Privacy Policy carefully. It should be read in conjunction with our Terms of Service.

Our Philosophy 
Jessica's Limited considers the protection of our customer’s privacy to be of the utmost importance. We are committed to acting in accordance with the Privacy Act 2020 (“the Act”) by providing you with a personalised service that meets your requirements in a way that doesn’t compromise your privacy.

We appreciate the trust you have placed in us by supplying us with your personal information. Our Privacy Policy explains our general practices in handling personal information and in particular how we may collect and use it in order to satisfy your particular requirements. It also outlines some of the security measures that we take in order to protect your privacy and gives certain assurances on things that we will not do.

Collection of Information 
We collect your personal information for the purposes of conducting our business and providing you with wig and beauty products and services. You agree to us collecting, holding, using and sharing your information for the purpose of conducting our business, managing wig subsidy claims and providing you with products and services relating to wigs and hairpieces.


When you provide us with personal information to establish your needs and entitlements, discuss your situation with your nominated healthcare professional,  deal with the Ministry of health in relation to your wig subsidy claims, complete a transaction, verify your credit card, place an order, arrange for delivery, etc., we infer that you consent to our collecting it and using it for that specific reason only. 

If we ask for your personal information for a secondary reason, such as marketing, we will either ask you directly for your express consent, or provide you with an opportunity to say no.

We collect a broad range of personal information, which may differ depending on which of our products and services you choose. The type of personal information we generally collect and store may include, but is not limited to: your name, address, date of birth, gender, contact details, including phone, fax and email, NHI number and conditions leading to hair loss. When you browse our online store, we also automatically receive your computer’s internet protocol (IP) address in order to help provide us with information that helps us learn about your browser and operating system.

Whenever possible, we collect personal information directly from you. Collection occurs when you first contact us, or request a product or service from us; however during the course of our relationship with you we may continue to collect more personal information. We may collect it in various ways, including but not limited to: over the phone, meeting with you in person, over the internet, from your nominated healthcare professional, from a relative or friend you nominate to act on your behalf, or when you fill in one of our or the Ministry of Health's forms.

If we request personal information from you and you do not provide it, we may not be able to provide you with the product or service you request, such as offering you a wig or hairpiece, or processing a claim with the Ministry of Health.

There may be occasions where we collect personal information about you from someone else (“a third party”). While we will normally try to collect the information directly from you, there may be some circumstances where we are not required to do so, for example where you have consented to us collecting it from someone else or where it is impractical.

Examples of where we may receive personal information about you from a third party and why this would happen include, but are not limited to, obtaining personal information from: 
• the Ministry of Health in relation to wig subsidy claims
• your nominated heath care professional, including but not limited to: hospitals, your GP surgery, nurse or medical specialist, in the course of assessing your claim for funding for wigs or hairpieces, or conditions leading to your hair loss 
• a relative or friend that you have authorised to deal with us on your behalf

When you give us information about another person (for example, when you are acting on behalf of a relative or friend), you confirm that you are authorised to do so, and you will inform them of the information you have provided, and will provide them with a copy of all documentation, including this Privacy Policy

The information you give us may be stored in electronic format, including in Cloud storage. We will always do our best to ensure your information is securely stored, whether in New Zealand or overseas.

We keep your personal information for as long as there is a business need, for example to help us manage your wig subsidy claims, or help you select products in the future. You can ask us to delete your personal information at any time, and we will comply if we do not have a reasonable justification for not doing so.

You can ask us for access to, and correction of information we hold about you at any time pursuant to the Privacy Act.  

Irrespective of the source of the information, we will respect and try to protect the privacy of your personal information.

USE OF INFORMATION

What we will do 
We will endeavour to only use your personal information in accordance with the Information Privacy Principles set out in the Act. Our general reason for the use of your personal information is to conduct our business and provide you with the wig and beauty products and services you require.

Other purposes for use of your personal information may include but are not limited to: 
- Keeping a record of the products you have purchased or have expressed interest in, so that we can calculate your wig subsidy balance, or help you find other products in future
- Helping contact you about new or improved services and products now or in the future 
- Helping prevent or detect fraud or loss 
- Contacting you by telephone or mail about our other services or products 
- Carrying out marketing analysis and profiling and creating statistical and testing information

You can contact us at any time and inform us that you do not wish to receive further communications about our products and services.

We will only send you marketing communications about our services or products by email or text message where you have consented to receiving those communications. You can always tell us at any time to change your preferences.

What we won't do 
We will not sell your personal information to other companies or persons

Disclosure of Information 
It is our Privacy Policy to only disclose your personal information to third parties in accordance with the Information Privacy Principles set out in the Act. The ability to disclose personal information, is limited under the Act to certain circumstances, which include where disclosure is required to maintain or enforce the law, or where the disclosure was for purposes, or directly related to purposes for which the information was originally collected. We may also disclose personal information to you as the customer or to a person authorised by you, but only where we reasonably believe that such an authority has been granted. 

The types of organisations to whom we disclose your personal information to will differ depending on the product or service you choose. Some typical disclosures that may be made in the course of our relationship with you include, but are not limited to, disclosures to: 
• the Ministry of Health and/or Government or statutory bodies 
• Hospitals, medical and health professionals in the course of assessing your claim for funding for wigs or hairpieces, or conditions leading to your hair loss 
• a relative or friend that you have authorised to deal with us on your behalf 
• Third-party service providers and mail houses 
• Legal and other professional advisers 
• Shopify (see below) 

In the course of operating our business we may disclose your personal information to service providers who assist us. In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services that they provide to us. However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect of the information we are required to provide to them for your purchase related transactions. For these providers we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers. 

Once you leave our stores website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

We have a designated Privacy Officer and a complaints process to address any concerns if needed. If you are not satisfied with the final decision that we make, you can direct your complaint to the Office of the Privacy Commissioner.
